Back to all policies

This Brand, Trademark, Copyright & Intellectual Property Notice (the “Notice”) is issued by Relly Belly Roll Co. Bakery (the “Company”) to identify and protect the Company’s brand identity, original creative works, confidential and proprietary materials, product identifiers, recipes and other intellectual property. This Notice is intended to place customers, competitors, vendors, contractors, content creators, social-media users and the public on notice of the Company’s claimed rights. It does not create rights that do not otherwise exist under applicable law, and nothing in this Notice should be read as preventing lawful fair use, truthful nominative reference, independent creation, or other uses permitted by law.

1Company Brand Identifiers and Trademarks

The Company claims rights, to the extent recognized by applicable law, in its distinctive source-identifying names, marks, logos, trade dress and product identifiers, including RELLY BELLY, RELLY BELLY ROLL CO., RELLY BELLY ROLL CO. BAKERY, the Company’s stylized logo and crown/heart/cinnamon-roll design elements, and distinctive menu-item names used by the Company, including “THE RELLY CLASSIC” and other product names the Company may introduce. The symbols ™ or SM may be used to indicate a claim of trademark rights. The ® symbol may be used only for a mark that is federally registered for the relevant goods or services. No person is granted any ownership interest or license merely by purchasing, viewing, sharing, following, reviewing, or otherwise interacting with the Company.

2Visual Identity, Trade Dress and Packaging

Protected or claimed brand assets include, where legally protectable, the Company’s distinctive combination and arrangement of blush pink, pink, cream, chocolate brown and gold; striped, polka-dot and related patterns; box configurations and decoration; labels and stickers; ribbons and bows; bakery display concepts; tent, table-banner and market-booth presentation; aprons, chef or hair-cover designs, utensils and branded merchandise; signage; menus; product cards; inserts; printed collateral; website presentation; and the overall coordinated look and feel of the Company’s commercial branding. Individual commonplace colors, stripes, dots, hearts, crowns, bakery imagery or other ordinary elements are not claimed exclusively in the abstract; the Company’s rights, where applicable, concern protectable original expression, distinctive marks, and/or distinctive combinations functioning as source identifiers.

3Copyrighted and Creative Materials

Unless otherwise stated, original photographs, videos, reels, graphics, illustrations, artwork, packaging artwork, label artwork, social-media posts, captions, written copy, advertisements, flyers, menus, product descriptions, website text, layout designs, promotional concepts, digital downloads, printed materials, brand guides, templates, mockups, signage artwork and other original creative works created by or for the Company are reserved to the Company or their respective rights holder. No permission is granted to copy, download, reproduce, crop, edit, recolor, trace, redraw, animate, translate, remix, republish, upload, distribute, sell, license, sublicense, create derivative works from, or commercially exploit such material except with prior written authorization or as otherwise permitted by law.

4Social Media, Digital Content and Online Use

The Company does not authorize third parties to take Company photographs, videos, graphics, captions, product imagery, branding, logo files, packaging images or other protected content and use them to market another bakery, food business, product, service, account, website, marketplace listing, advertisement or commercial venture. Unauthorized removal of watermarks, logos, copyright notices, metadata or other rights-management information is prohibited to the extent provided by law. Tagging, linking to, commenting on, or using platform-native sharing tools does not transfer ownership. Reposting or other use requiring permission should be authorized in writing.

5Product Names, Menu Presentation and Branding on Goods

The Company reserves its rights in distinctive product names and source-identifying menu terminology that it owns or validly claims. Third parties may not use confusingly similar branding, packaging, menu presentation, labels, stickers, signage or promotional materials in a manner likely to cause consumers to believe that another product or business is sponsored by, affiliated with, licensed by, endorsed by, or originates from Relly Belly Roll Co. Bakery. This Notice does not claim exclusive ownership of generic or merely descriptive food terms except to the extent they acquire legally protectable distinctiveness.

6Recipes, Formulas, Methods and Confidential Know-How

The Company’s nonpublic recipes, formulas, ingredient ratios, preparation specifications, production notes, internal manuals, costing information, supplier information, testing notes, techniques and other confidential know-how are proprietary to the extent protected by contract, trade-secret law or other applicable law. No person receiving confidential materials under an agreement, employment relationship, contractor relationship, vendor relationship, nondisclosure obligation or other duty of confidentiality is authorized to disclose, reproduce, sell, license, teach, publish, distribute or commercially exploit them contrary to that duty. This Notice does not purport to create trade-secret protection for information that is publicly known, readily ascertainable, independently developed, lawfully obtained without a duty of confidentiality, or otherwise not legally protectable.

7No Implied License; Written Permission Required

Except for rights necessarily granted by law or expressly granted in a signed written agreement, no license or permission is implied. Requests to reproduce, license, collaborate with, wholesale, distribute, feature commercially, or otherwise use Company intellectual property should be submitted to the Company in writing. Permission for one specific use does not authorize any other use, platform, campaign, product, territory, duration, modification or sublicense unless expressly stated in writing.

8Prohibited False Association, Passing Off and Misrepresentation

No person may falsely represent that they are the Company, an authorized Relly Belly bakery, franchisee, licensee, partner, reseller, employee, spokesperson, affiliate or approved collaborator. No person may use Company identifiers or confusingly similar identifiers in usernames, domain names, marketplace storefronts, advertisements, metadata, hashtags, packaging, labels or other commercial contexts in a manner that is likely to cause confusion as to source, sponsorship, affiliation or approval.

9Vendors, Contractors, Photographers and Collaborators

Unless a written agreement states otherwise, vendors and contractors receive only the limited access necessary to perform authorized services. Possession of Company files, artwork, photographs, recipes, specifications, customer information or other materials does not authorize reuse for another client, portfolio publication, resale, template creation, training data, advertising, merchandising or any other purpose. Ownership and permitted-use terms for commissioned works are governed by the applicable written agreement and copyright law.

10Enforcement and Remedies

The Company reserves the right to investigate suspected infringement or misuse and, where legally appropriate, request removal or correction, submit platform or marketplace intellectual-property complaints, send cease-and-desist correspondence, pursue contractual remedies, seek injunctive relief, damages, an accounting of profits, statutory damages where available, costs, attorneys’ fees where authorized, and any other relief available under applicable law. The availability and amount of any remedy depend on the facts, applicable law, registrations, contracts and other circumstances. Nothing in this Notice guarantees that any particular claim or remedy will be available.

11Reservation of Rights and Legal Limitations

All rights not expressly granted are reserved. The Company does not waive any rights by delay, silence, failure to enforce on one occasion, or permission granted for a different use. This Notice is not a substitute for federal or state trademark registration, copyright registration, confidentiality agreements, work-for-hire/assignment agreements, licensing agreements, terms of sale, website terms, privacy policies or other legal instruments. The scope of the Company’s rights is determined by applicable law and the facts surrounding ownership, originality, distinctiveness, priority, use, registration, confidentiality and consumer perception.

12Notice to Recipients

If you believe you have received Company material in error, believe a use is authorized, or wish to request permission, contact the Company before commercial use. Written permissions and licenses should identify the exact asset, purpose, platform, duration, territory and any permitted modifications.

13Digital Products, Downloads and Educational Materials

If the Company offers recipes, guides, classes, templates, downloads, videos, demonstrations, training materials or other educational products, purchase or access does not transfer ownership. Unless a separate written license expressly states otherwise, the purchaser receives only a limited, personal, non-exclusive, non-transferable license to use the material for the purpose stated at purchase. No purchaser may redistribute, resell, sublicense, upload, publish, teach from, convert into a competing educational product, or make the material available to another person or business without prior written permission.

14Artificial Intelligence, Datasets and Automated Systems

To the extent permitted by applicable law, Company-owned confidential materials and copyrighted content may not be knowingly submitted, uploaded, scraped, harvested, copied or supplied to third-party artificial-intelligence systems, model-training datasets, image generators, content generators, automated design systems, or similar commercial tools for the purpose of reproducing, imitating, training on, or creating competing versions of the Company's protected content, branding or proprietary materials without written authorization. This provision does not prohibit lawful uses that do not require Company permission.

15Commercial Licenses and Authorizations

Any commercial license, collaboration permission, content license, recipe license, merchandising permission, wholesale authorization or other special authorization must be in writing and must identify its scope. The Company may condition an offered license on stated limitations concerning territory, duration, channels, products, branding, attribution, confidentiality, transfer, sublicensing and termination. Unless a signed agreement expressly provides otherwise, an authorization is not transferable and does not grant ownership of the underlying intellectual property.

16Purchases, Refunds and Digital Delivery

Refund, cancellation and return rules for food products, merchandise, digital products, classes, deposits and custom work should be stated in the applicable checkout terms or sales policy. For digital materials that are delivered or made accessible immediately, the Company may establish an all-sales-final policy to the extent permitted by law. Nothing in this Notice limits any non-waivable consumer right or remedy required by applicable law.

17Acceptance of Separate Terms; Version Control

Where the Company requires contractual Terms and Conditions, a license, confidentiality agreement, vendor agreement or other binding terms, those terms should be affirmatively presented and accepted before the relevant transaction or access occurs. The Company should retain dated versions of its terms and records of assent. A later revision does not retroactively replace the terms governing an earlier transaction unless the parties validly agree otherwise.

18Disclaimers and Limitation of Liability

Any product-specific disclaimers, allergy notices, food-safety notices, educational disclaimers, warranty limitations and limitations of liability should appear in the Company's applicable customer Terms and Conditions and product materials. Such provisions apply only to the extent enforceable under applicable law and should not attempt to waive rights or liabilities that cannot legally be waived.

19Governing Law, Venue and Attorneys' Fees

For contracts entered into by the Company, the Company may adopt a separate Terms and Conditions agreement specifying Nevada governing law and an appropriate forum for disputes, subject to applicable jurisdictional and consumer-protection rules. Any provision seeking recovery of attorneys' fees and costs should be placed in the governing contract and drafted so that it applies only where authorized by contract or law. This public Notice alone is not intended to impose contractual venue or fee obligations on persons who have not agreed to them.

20Competition and Independent Development

The Company does not claim a general right to prevent lawful competition. Competitors remain free to independently develop and sell their own products and use unprotected ideas, methods, ingredients, styles and common bakery concepts. They may not, however, misappropriate protected confidential information, infringe valid intellectual-property rights, breach an enforceable agreement, pass off their goods as the Company's, or use confusingly similar source-identifying branding in violation of applicable law.

21Recommended Companion Documents

For stronger operational protection, this Notice should be used alongside separate, transaction-specific documents: (a) Website and Sales Terms & Conditions; (b) Privacy Policy; (c) Refund/Cancellation Policy; (d) Digital Product or Recipe License, if applicable; (e) Vendor/Contractor Confidentiality and IP Assignment Agreement; (f) Photographer/Designer Work Product and Usage Agreement; (g) Commercial Licensing Agreement; and (h) appropriate trademark and copyright registrations. Those documents create contractual obligations that a public brand notice by itself cannot create.
